
August 23, 2010 - New Jersey - A New Jersey healthcare service provider is facing a lawsuit after employee complaints of discrimination over disabilities and unfair practices concerning medical leave.
Princeton HealthCare Services of Mercer County, NJ is the target of a lawsuit filed by the U.S. Equal Employment Opportunity Commission on August 11. The lawsuit focuses on Princeton HealthCare's leave policies that do not reasonably accommodate those with disabilities. Their policies also allow for the termination of employees who are not qualified for leave under the Family Medical Leave Act if they are unable to return to work after 7 days.
Another violation brought against Princeton HealthCare is their refusal to grant exceptions to their policies for qualified employees with disabilities who need additional leave. This conduct violates the Americans with Disabilities Act which requires that employers provide reasonable accommodations to employees with disabilities.
The lawsuit was sparked after more than a dozen employees with disabilities were denied a leave of absence as a reasonable accommodation for their disability. Many of these employees were then fired from Princeton HealthCare. A pre-litigation settlement was attempted through the District of New Jersey court through its conciliation process, but the attempt was fruitless. The Americans with Disabilities Act protects disabled individuals from many types of discrimination, including employment.
