Judges Who Hear SSD Claims Facing Violent Threats

Posted on Nov 29, 2010

November 22, 2010 New reviews by the Social Security Administration (SSA) show a disturbing increase in threats of violent action against judges who hear Social Security disability cases.

The Washington Post reported on an annual review conducted by the SSA. There were at least 80 threats reported across the country directed at administrative law judges or court staff. This is an 18% increase from last year's reporting period and comes with the growing frustration of claim denials and the backlogged system.

The threats have so far been verbal and not just against the judges themselves but also toward their families and the entire court building. A Senate subcommittee hearing in Akron, Ohio, held on November 15 discussed the growing number of threats. The lawmakers present cited the recent attempts at clearing up the claims backlog as being too ineffective in providing individual relief.

Social Security Commissioner Michael J. Astrue assured the subcommittee that they are making progress, but the 2013 goal is at risk to be met because of the rise in claims and the recession, as well as the baby boomer generation reaching the age where disability claims tend to rise.

Luckily there have been no reports of the actual threats carried out this year, although past years were different. Past reports have included information on judges harmed by thrown chairs, fistfights, and disgruntled gunmen. When claimants are denied their benefits during hearings, things can turn ugly quickly.

The best way to avoid frustration in the Social Security disability claims process is to have all of your correspondence with the SSA reviewed and filed by an experienced New York disability lawyer. Your lawyer can handle many of the hassles of corresponding with the SSA and responding to deadlines for your claim.
