Fired Aide Sues Liberty School District for Disability Discrimination

August 28, 2010 - Christopher Salonich, a teacher's aide at Liberty Middle School for 9 months during the 2008-2009 school year, has filed a lawsuit against the Liberty School District claiming discrimination and harassment because of his disability.

The Times-Herald Record
reports Salonich, who suffers from herniated discs, is seeking lost wages and benefits, as well as compensation for  "humiliation, mental anguish, and emotional distress" in the suit that was filed with the U.S. District Court on August 17th.

In the lawsuit, Salonich claims his job performance was satisfactory, but he began receiving negative evaluations because the district was concerned he "was on disability" after previously working for a phone company. The concerns were documented in a note signed by Liberty School Superintendent Mike Vanyo, The note asked an unnamed recipient to "see what you can find out so we are making a smart choice."

Salonich also claims negative write-ups were issued on two occasions based on observations of his in-class performance. Another accusation he brings is that Liberty Middle School Principle Mary Greynolds and Eileen Whitaker, Director of Special Student Services, extended his probationary period without just cause. This 3-month extension was approved by the school board.

Before  the lawsuit, Salonich had filed a claim with the U.S. Equal Employment Opportunity Commission (EEOC) on October 25, 2009. The court documents show he was given an EEOC notice informing him of his right to sue, thus prompting the current lawsuit.
