Disability Rights Group Sues NYC Taxi Commission for Discrimination

January 13, 2011 - New York City, NY -With only 231 of the more than 13,000 taxicabs in New York City accessible to those who rely on wheelchairs, change is needed.

The Examiner.com website announced the Disability Rights Advocates group has filed a federal class-action lawsuit against the Taxi and Limousine Commission seeking reform in their vehicle fleet. Trying to find a wheelchair-accessible taxi in the busy New York traffic makes being on time a huge struggle for those who rely on taxis for transportation to work.

Chris Noel, one of the plaintiffs in the lawsuit and co-chair of the Taxis For All Campaign, is concerned that he pays the taxes to fund the taxi services, but can't get one to stop for him. Noel and the other plaintiffs are not seeking money in the lawsuit, but a new rule requiring taxi replacements be wheelchair-friendly, highlighting one of the most important disability issues in urban areas.

The Taxi and Limousine Commission argues it has already made great strides in increasing accessibility for the disabled. A spokesman for the TLC says there are no laws requiring taxicabs to be accessible, and the Americans With Disabilities Act (ADA) has an exemption specifically noting taxicabs.

The lawsuit counters the argument with the fact that the TLC is a government entity, and the exemption is for private entities. Consequently, they are hoping for a win in their case, as old taxis are retired from service, the replacements will be required to be wheelchair-friendly.
