8 Queens Residents File Suit against Office of Disability Assistance

April 22, 2011 - Queens, NY - Eight disabled Queens residents are taking their complaints to court after a series of intentional legal and procedural errors led to the denial of their Social Security disability claims.

A press release from the Urban Justice Center posted on PRNewswire confirms the filing of a class action lawsuit by several disabled Queens residents who were repeatedly denied Social Security disability benefits due to decisions made by 5 Administrative Law Judges (ALJs).

The ALJs in question are members of the Queens Office of Disability Assistance & Review, which has the 3rd highest rate of Social Security disability benefit denials in the country and the highest rate in the New York region. Nearly all of the judges named in the suit are highly ranked for rates of denial of disability claims.

The class action lawsuit claims that the ALJs were guilty of persistent and intentional denials based on misconduct, deficient analysis of the case, and questionable rationale. Even after numerous warnings and reversals by the Brooklyn federal courts, these errors persisted.
