Unfortunately, every day on America’s streets and highways, thousands of car, truck and van accidents happen, changing individuals and their family’s lives forever. New York and New Jersey highways are becoming more and more crowded with passenger cars and tractor trailer trucks. The roads are so crowded and congested that serious accidents are happening much more frequently.
Most people will never be involved in a car accident. However, some may question what will happen to me after a car accident?
Immediately after the accident, you will most likely receive emergency treatment from an ambulance or paramedic at the scene. If your injuries are severe, you will be taken by an ambulance to a local hospital for and examination and possibly a stay. You should not be concerned about your medical bills. If you were involved in an accident in New York State, car insurance, whether yours, the car you were riding in, the car you had an accident with or the bus you were a passenger in, will help to pay your medical bills. This is known as No-Fault benefits.
The police will generally come to the scene of accident. But, by the time the police arrive, you may have already been taken to the hospital. Sometimes the police will come to the hospital to obtain your statement, sometimes they won’t. As the officer who writes the report generally did not witness the accident, what is written down in the report won’t be held against you. Under New York State law, you are required to file an MV-104, a Driver’s Report of Accident,
-The police accident report contains very useful information. Listed on the report is the name of the driver that you were in the accident with, the owner of the vehicle and their addresses, as well as their insurance company, usually by a 3-digit number.
-The Report also contains a description of the accident and where it happened, based upon the police officers investigation at the scene. The accidents are listed as Rear End, Left Turn, Overtaking, Right Turn, Right Angle, Head On and Sideswipe. The Report also includes Vehicle Damage Codes which list the point of impact on your car, ranging from the front to the back.
-Finally, the police report will list any witnesses to the accident. This information is very important but unfortunately, is not always the police officer's priority at the accident scene. So if someone tells you that they are a witness, please make sure that you take down their name and number.
Frequently, after an accident, you will be contacted by the insurance company for the car that you were in the accident with. Some accidents you won't need a lawyer to represent but before you talk to the adjuster, please read my free book, The New York Accident Book. The insurance company will ask you numerous questions about your injuries and how the accident happened and try to settle your claim for little money, without knowing the true extent of your injuries.
