Q: Why a seller doesn't give a Property Condition Disclosure Statement (PCDS)

A: A seller of residential property is required by NYS law to give the buyer a disclosure statement *before contract) or a $500 credit at closing.  If the seller gives the credit he insulates himself fro liability for any misstatement on the PCDS and if there is a defect the seller would not be responsible unless he actively concealed the defect.
