Determining Fault and Liability
In order to determine who is liable for this death from an ATV accident we would need to know more about the situation. We would need to know if the driver of the vehicle was driving wrecklessly or carelessly at the time of the accident. Depending on the answer to that question would determine whether or not it would make this ATV accident a wrongful death case or not. A thorough and proper investigation of this case will help determine if the driver of the vehicle was distracted at the time of the accident when they should have been paying attention to the road or if he was paying attention and did everything in his power to avoid the accident.
