Social Security Work Incentives and New Yorkers

Are you a disabled and receiving Social Security benefits in New York? Have you ever wondered if you would still be eligible to receive those benefits if you returned to work?

Fortunately, the Social Security Administration (SSA) has recognized that many disabled people receiving benefits want to return to work. Therefore, they have developed programs to allow people to do so.

The SSA’s website highlights three work incentives including a trial work period. This allows you to return to the workplace for a period of nine months to determine if you can work before your benefits run out.

They also offer an extended period of eligibility. This allows you to earn benefits during a three-year period if your earrings are not “substantial” enough to make ends meet.

Lastly, they offer an expedited reinstatement. If you return to work, and after five years, determine that you can no longer work, you can reapply without having to file a new disability application.

As you can imagine, determining if you are eligible for these programs can be a daunting task. You should seek legal counsel to assist you in determining if you are eligible.

If you or someone you know is applying or having trouble obtaining Social Security benefits, you should contact an experienced Staten Island Social Security attorney at the law offices of Decker, Decker, Dito and Internicola at (718) 979-4300 or (800) 976-4904.
