The New York workers’ compensation law gives surviving dependants the ability to obtain financial benefits. This law provides that if the New York worker dies because of a compensable injury, meaning one that is covered by workers’ compensation insurance, then the dependants may qualify for weekly benefits. These benefits are equivalent to two-thirds of the worker’s average weekly income for the year prior to the deadly on-the-job-accident.
Based on the workers’ comp law, dependants include the spouse, minor children or other family member. It is important to note that the benefits paid will not be in excess of the weekly maximum allowed by the law, even if there are numerous dependants.
