Elle's Law is a law being considered for New York which would cause reckless and careless drivers to face time in prison and a suspension of license if a pedestrian sustains serious physical injury as a result of their actions while driving. Currently the only punishment for causing injury to a pedestrian by driving recklessly is a ticket. New York Law Will Punish Reckless Drivers Injuring Pedestrians with More than a Ticket If Passed

A New York law that is being proposed would make sure that wreckless drivers who cause accidents resulting in serious injuries will get more punishment than just a ticket.

The law is gaining support by many in New York state and is known Elle's Law.  Elle's Law was created by Heather Vandenberghe, Elle's mother, after Elle Vanderberghe, a toddler at the time, was mowed down by a driver who was speeding down the street in reverse to get a parking spot.  Elle was left with brain damage after being hit by the car and her mother says that it added insult to the injuries her daughter sustained from the accident when she found out that nothing was going to happen to the wreckless and negligent driver except for a reckless driving ticket.  Now Heather is fighting for Elle's Law to be passed which would cause negligent and wreckless drivers to be held accountable for their actions with more than just a ticket if there are injuries and/or deaths involved as a result of the accident.

Elle's Law would the crime of vehicular assult in the third degree if negligent or wreckless driving is involved. This would be punishable by up to four years in prison and a license suspension for up to seven years for the reckless driver who causes serious injuries to a pedestrian in New York.

Has Something Similar Happened to You?

Far too many people in New York die or are severely injured from being hit by cars, trucks, buses and other vehicles.  If you are a pedestrian or the parent of a child who was a pedestrian who was severely injured by a vehicle who was driving recklessly or carelessly it is important that you have your accident evaluated by an experienced injury attorney in New York.  An injury attorney can help you determine who was at fault, how much your case is worth for the injuries you sustained, and how to go about being compensated.  Elle's law would help add to this so that not only would compensation for a pedestrian related injury be able to be sought and a ticket be issued but would cause the driver to suffer a license suspension and also face time in prison.
